MoEF&CC OM dated 31.10.2019 and 30.12.2019 regarding to CEPI are kept in abeyance as per the Hon'ble Supreme Court order dated 22.09.2020.

Subject: Compliance of order dated 22.09.2020 of Hon'ble Supreme Court in the matter of Civil Appeal Dy. No. 19271/2020 in the matter of Gujarat Chambers of Commerce Industry vs Central Pollution Control Board & Anr - reg.

 

 

 

1. The Ministry had issued two Office Memoranda of even number dated31st October 2019, and 30th December 2019 regarding the compliance of the  order of Hon'ble NGT in OA No.  1038/2018 dated  19.08.2019 (published  on 19). 

 

2. The Hon'ble Supreme Court vide order dated 22.10.2020 in the matter of Gujarat Chambers of Commerce and Industry Vs Central Pollution Control Board & Anr., has imposed a stay on the operation of the impugned order of the NGT mentioned above.

 

3. In view of the orders of the Hon'ble Supreme Court, the two Office Memoranda of even number dated 31st October 2019, and 30th December 2019 are hereby kept in abeyance .

 4.  This issues with the approval of the Competent Authority.

Standardizing the validity of baseline data and public consultation reports for submission of proposal within the validity period of Terms of Reference (ToR) under the provisions of EIA Notification, 2006 - regarding.

 Dated: 08 th June 2022 As per the provisions of EIA Notification, 2006, Terms of References (ToR) are being accorded to the various developmental projects listed in the schedule to the EIA Notification, 2006 except schedule 8(a) for undertaking EIA/EMP study. In this regard, Ministry issued Office Memorandum No. J-11013/41/2006-IA-II (I) (Part) dated 29th August 2017 stating that the validity period of ToR as three years for all the projects/ activities and four years for River Valley and HEP Projects.
