Environment clearance is required for manufacturing of organics products or not?

  MoEF&CC has published the circular related to Environment clearance is required for manufacturing of organics products or not on dated 9 th January 2023.   As per this published Circular by MoED&CC, New Delhi,   Project which pertain to extraction of organic compounds from plants without any chemical synthesis, but involve mixing/blending, percolation with water and extracting with solvent, are not covered under “5(f) –Synthetic Organic chemical Industry of the schedule of the EIA Notification 2006 and shall not require prior Environment Clearance” However, requisite consent to establish/operate shall be obtained from the Concerned state Pollution Control Board/UT Pollution Control Committee under the provision of Air Act, 1981 and water act, 1974. Further, manufacturing of synthetic organic chemical to be used for the above extraction, if any, shall require EC as per the provisions of EIA Notification, 2006 as amended from time to time.

3(a) Metallurgical Industries

MoEF&CC has published the Notification related to 3(a) Metallurgical Industrie s dated 20 th July, 2022. Whereas, the Hon’ble National Green Tribunal vide its order, dated the 12th February, 2020, in Original Application No. 55/2019 (WZ), (Gajubha Jesar Jadeja vs Union of India &Ors.), has inter alia observed that Cold Rolled Stainless Steel Manufacturing Industries require prior environment clearance but, having regard to the fact that there were a large number of such mills operating on the strength of Consent to Establish (CTE) and Consent to Operate (CTO), the Hon’ble Tribunal has held that opportunity should be provided to such units to fall within the Environment Clearance regime by granting a period of at least one year to operate for the purpose; And whereas, the Central Government, keeping in view the impact caused due to the Covid19 pandemic has taken a considered decision in line with the above said order of the Hon’ble National Green Tribunal, so as to provide a ...

In this context, find enclosed herewith the mechanism for environmental management of Critically and Severely Polluted Areas and consideration of activities/projects in such areas in compliance of directions issued by Hon'ble National Green Tribunal on 19.08.2019 (published on 23.08.2019) in OA. No. 1038 2018. The enclosed Mechanism may be shared with the State/UT Governments and SPCB/PCCs for implementation. However, the report regarding CEPI and EPI assessment study done by CPCB may be put up to the Ministry for further deliberation.
